diagram-generator.com provides AI-powered diagram generation services. Our service includes, but is not limited to, generating the following diagram types:

  • Flowcharts
  • Sequence diagrams
  • Class diagrams
  • Entity relationship diagrams (ERD)
  • State diagrams
  • Gantt charts
  • Mind maps
  • Network diagrams
  • And other diagram types as listed on our platform

AI Models Used:

  • Standard Mode: Claude AI by Anthropic for diagram code generation
  • Pro Mode: Nanobanana Pro for enhanced image generation capabilities

The Service uses artificial intelligence to interpret your text descriptions and generate diagram code in various formats (Mermaid, PlantUML, etc.). Generated diagrams are stored in our database and can be accessed via shareable links.

3. AI-Generated Content and Limitations

Important: Our Service uses AI to generate diagrams. You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or "hallucinations" (incorrect or misleading information generated by the AI)
  • Generated diagrams should be reviewed for accuracy before use in production, critical applications, or decision-making processes
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated diagrams
  • You are solely responsible for verifying and validating any diagrams generated by the Service
  • The AI may not always interpret your input as intended, and multiple attempts may be necessary to achieve desired results

4. User Responsibilities

When using the Service, you agree to:

  • Use the Service for lawful purposes only
  • Not submit content that is illegal, harmful, threatening, abusive, or offensive
  • Not overload, disrupt, or attempt to gain unauthorized access to the Service
  • Not attempt to bypass any rate limits or service restrictions
  • Respect intellectual property rights of others
  • Not use the Service to generate diagrams containing sensitive personal information or confidential data
  • Review and verify all AI-generated diagrams for accuracy before use
  • Not reverse engineer, decompile, or attempt to extract the source code of the Service

5. Data Storage and Third-Party Services

By using the Service, you acknowledge and agree that:

  • Your diagram content is processed by our AI providers (Anthropic and Nanobanana) for generation purposes
  • Generated diagrams are stored in our database infrastructure
  • Your data is subject to the privacy policies of these third-party services
  • We use cookies and tracking technologies as described in our Privacy Policy
  • Shareable links to your diagrams may be publicly accessible to anyone with the link (subject to your subscription tier)

6. Intellectual Property, Ownership, and Commercial Use

6.1 Ownership by Subscription Tier

Free Tier Users:

  • Diagrams generated using free credits are owned by diagram-generator.com
  • Free-tier diagrams may be displayed in our public gallery with watermarks
  • You are granted a limited, non-exclusive, non-transferable license to use free-tier diagrams for personal, non-commercial purposes only
  • Free-tier diagrams may not be used for commercial purposes, resale, or redistribution
  • We reserve the right to use, display, and promote free-tier diagrams as examples of our service

Paid Subscribers (Lite, Pro, and higher tiers):

  • You retain full ownership of all diagrams generated under your paid subscription
  • Your diagrams are private and will not be displayed in any public gallery
  • Your diagrams will not include watermarks
  • You are granted a perpetual, worldwide, royalty-free license to use your generated diagrams

6.2 Commercial Use Rights

Free Tier:

  • Commercial use is NOT permitted
  • Diagrams may only be used for personal projects, learning, and evaluation purposes

Paid Subscribers:

  • Full commercial use is permitted, including but not limited to:
    • Use in client presentations and deliverables
    • Inclusion in commercial products and services
    • Use in marketing materials
    • Publication in books, articles, and educational materials
    • Use in software documentation
    • Internal business use and training materials

6.3 Public Gallery and Watermarks

  • Free-tier diagrams may appear in our public gallery to showcase the Service's capabilities
  • Watermarked diagrams in the public gallery remain the property of diagram-generator.com
  • Paid subscribers' diagrams are excluded from the public gallery and are watermark-free
  • We may remove any diagram from the public gallery at our sole discretion

6.4 License Grant to diagram-generator.com

Free Tier Users: By using the Service, you grant diagram-generator.com an exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your generated diagrams for any purpose, including marketing and promotional activities.

Paid Subscribers: By using the Service, you grant diagram-generator.com a non-exclusive, worldwide, royalty-free license to store, process, and transmit your content solely for the purpose of providing and improving the Service. We will not publicly display, share, or use your diagrams for marketing purposes without your explicit consent.

6.5 Our Content

The Service itself, including its design, code, features, branding, and underlying technology, is owned by diagram-generator.com and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service.

7. Subscription Plans, Payments, and Refund Policy

7.1 Subscription Plans

The Service offers the following subscription tiers:

  • Free Tier: Limited trial credits for evaluation purposes
  • Lite Plan: Monthly subscription with allocated credits
  • Pro Plan: Monthly subscription with higher credit allocation and additional features

Credit allocations and pricing are detailed on our Pricing page and may be updated from time to time.

7.2 Billing and Payments

  • Subscriptions are billed monthly in advance
  • Payment is processed through our third-party payment provider
  • You authorize us to charge your payment method on a recurring basis
  • Prices are listed in USD and exclude applicable taxes
  • Failed payments may result in service suspension

7.3 Refund Policy

Subscription Refunds:

  • You may request a full refund within 7 days of your initial subscription purchase if you have not used more than 10% of your allocated credits
  • After the 7-day window, subscription fees are non-refundable
  • Partial month refunds are not provided for cancellations mid-billing cycle
  • Downgrading to a lower tier takes effect at the next billing cycle; no refunds are issued for the current period

Credit Refunds:

  • Unused credits are non-refundable and non-transferable
  • Credits do not roll over between billing periods unless otherwise specified in your plan
  • Purchased credit top-ups are non-refundable once added to your account

Exceptions:

  • If you experience significant technical issues that prevent you from using the Service, you may contact us within 14 days for a case-by-case review
  • Refunds may be issued at our sole discretion in cases of documented service failures
  • Chargebacks or payment disputes initiated without first contacting us may result in account termination

How to Request a Refund: To request a refund, contact us at info@diagram-generator.com with:

  • Your account email address
  • Date of purchase
  • Reason for refund request

Refund requests are typically processed within 5-10 business days.

7.4 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • You will retain access to paid features until the end of your billing period
  • Upon cancellation, your account reverts to Free Tier status
  • Unused credits expire upon cancellation and are not refundable

8. Service Limitations and Availability

  • The Service is provided "as is" and "as available" without warranties of any kind
  • We may impose usage limits, rate limits, or quotas to ensure fair service for all users
  • Some features may be experimental, in beta, or subject to change
  • We do not guarantee uninterrupted, timely, secure, or error-free service
  • Service availability may be affected by maintenance, updates, or technical issues
  • AI processing times may vary depending on system load and complexity of requests

9. Prohibited Uses

You may not use the Service to:

  • Generate diagrams containing illegal, harmful, or malicious content
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity
  • Engage in automated scraping or data harvesting
  • Attempt to circumvent security measures
  • Generate content that infringes on third-party copyrights or trademarks

10. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms of Service periodically. Continued use of the Service after such changes constitutes your acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.

11. Account Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of the Service or other users
  • Excessive or automated usage that impacts service quality
  • Non-payment for subscription services

Upon termination:

  • Free-tier users' diagrams remain in the public gallery
  • Paid subscribers may request deletion of their diagrams within 30 days of termination
  • We are not obligated to retain your data after account termination

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • AI-generated diagrams will be accurate, complete, or suitable for your purposes
  • Any errors or defects will be corrected
  • The Service will meet your specific requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Inaccurate, incomplete, or misleading AI-generated content
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless diagram-generator.com, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit or generate using the Service
  • Your commercial use of generated diagrams (if applicable to your subscription tier)

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
